The terms applicable to an order are those in force at the time the order is placed.
ACCOLADE reserves the right to amend these terms at any time. Any amendments will not apply retroactively to orders already concluded.
3. Products
The products offered for sale are presented on the website together with their essential characteristics.
ACCOLADE makes every reasonable effort to present the products, their colors, materials, dimensions and details as accurately as possible.
However, colors may vary slightly depending on the screen and settings of the device used.
Photographs and visuals are provided for illustrative purposes and do not replace the information contained in the product description.
Products are offered subject to availability.
ACCOLADE reserves the right to withdraw a product from sale or modify its presentation at any time, without affecting orders that have already been confirmed.
4. Prices
The applicable prices are those displayed on the website at the time the order is placed.
Prices displayed on the website are stated in euros. Applicable taxes are indicated in accordance with current regulations.
Shipping costs are not included in the product price unless otherwise stated. They are displayed to the customer before the order is finally confirmed.
For orders shipped outside the European Union, customs duties, import taxes or other local charges may be imposed by the authorities of the destination country.
Unless otherwise stated at the time of ordering, any such duties, taxes and import charges are the responsibility of the customer.
ACCOLADE reserves the right to modify its prices at any time, without affecting orders that have already been confirmed.
5. Orders
The customer selects the products they wish to purchase and follows the various steps of the ordering process.
Before finally confirming the order, the customer may review its contents and total price and correct any errors.
Confirmation of the order entails an obligation to pay.
Once the order has been placed, the customer receives a confirmation email at the address provided during the purchase.
ACCOLADE reserves the right to refuse or cancel an order, particularly in the event of:
- suspected fraud;
- payment issues;
- obvious pricing errors;
- product unavailability;
- clearly incorrect shipping information;
- an order that is manifestly unusual or abnormal.
Where a paid order is cancelled by ACCOLADE, the corresponding amounts will be refunded to the customer.
6. Payment
Payment is made at the time of the order using the methods offered on the website.
Available payment methods may include bank cards, PayPal, Apple Pay, Shop Pay or any other payment method offered during checkout.
Payments are processed by Shopify Payments and/or the payment providers available on the website.
ACCOLADE does not have access to the customer’s full banking details.
The order may be suspended or cancelled if payment is refused or unsuccessful.
7. Delivery
Products are delivered to the destinations offered on the website at the time the order is placed.
Available delivery methods and shipping costs are displayed to the customer before the order is confirmed.
Displayed delivery times are estimates unless a specific delivery date or period has been expressly agreed.
The customer is responsible for ensuring that the shipping address provided is accurate and complete.
If an incorrect address attributable to the customer results in the parcel being returned, the customer may be charged for the cost of reshipping.
Shipping Risk
Where the carrier has been offered by ACCOLADE, the risk of loss of or damage to the product passes to the customer when the customer physically takes possession of the product.
If the customer chooses a carrier other than those offered by ACCOLADE, the risk may pass when the product is handed over to that carrier, in accordance with applicable law.
8. Right of Withdrawal
Consumers have 14 days from receipt of their order to exercise their right of withdrawal, without having to provide any reason.
To exercise this right, the customer must clearly inform ACCOLADE of their decision, in particular by email at:
and indicate their order number.
After notifying ACCOLADE of their withdrawal, the customer has 14 days to return the product.
The direct cost of returning the product is the responsibility of the customer.
ACCOLADE does not provide prepaid return labels in the case of a simple change of mind.
The return address is provided to the customer after their return request.
The product may be tried on to the extent necessary to establish its nature, characteristics and size.
The customer may be held liable for any decrease in the value of the product resulting from handling beyond what is necessary to inspect it.
Sale or discounted items are also covered by the statutory right of withdrawal where applicable.
For orders shipped outside the European Union, any mandatory consumer protection provisions applicable in the relevant country remain applicable where they cannot legally be excluded.
9. Refunds Following Withdrawal
Where the right of withdrawal has been validly exercised, ACCOLADE will refund the amounts due in accordance with applicable law.
The refund will be made using the payment method used for the original order, unless otherwise agreed.
ACCOLADE may withhold the refund until the product has been recovered or until the customer provides proof that it has been shipped, whichever occurs first.
Return shipping costs remain the responsibility of the customer.
Where required by law, the refund of the original shipping costs is limited to the cost of the least expensive standard delivery method offered when the order was placed. Additional costs resulting, in particular, from an express delivery option voluntarily selected by the customer are not refundable.
10. Exchanges
ACCOLADE does not offer direct exchanges.
If a customer would like another size or a different product, they must return the relevant product in accordance with the conditions above and then place a new order.
Any new order remains subject to product availability.
11. Defective or Non-Conforming Products
If a product received is damaged, defective or different from the product ordered, the customer may contact:
and provide their order number and, where useful, photographs showing the issue.
This provision does not limit the customer’s statutory warranty rights.
12. Statutory Warranties
ACCOLADE, whose contact details are set out in Section 1 of these Terms and Conditions, is responsible for the statutory warranties applicable to the products sold.
Statutory Warranty of Conformity
Consumers have a period of two years from delivery of the goods to invoke the statutory warranty of conformity where a lack of conformity arises.
During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it arose.
The statutory warranty of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without significant inconvenience to the consumer.
Where the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the initial warranty period.
Where the consumer requests repair but the seller requires replacement, the statutory warranty of conformity is renewed for a period of two years from the date on which the replacement goods are delivered.
The consumer may obtain a price reduction while keeping the goods or terminate the contract and obtain a refund in exchange for returning the goods in the circumstances provided for by law, including where:
- ACCOLADE refuses to repair or replace the goods;
- repair or replacement takes place more than thirty days after the request;
- repair or replacement causes significant inconvenience to the consumer;
- the lack of conformity persists despite an attempt to bring the goods into conformity.
The consumer may also obtain an immediate price reduction or terminate the contract where the lack of conformity is sufficiently serious to justify doing so.
However, the consumer may not terminate the contract where the lack of conformity is minor.
The rights arising from the statutory warranty of conformity are provided for in Articles L.217-1 to L.217-32 of the French Consumer Code.
Warranty Against Hidden Defects
Consumers also benefit from the statutory warranty against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect.
Subject to the conditions provided by law, this warranty may allow the consumer either to keep the product and obtain a reduction in price or to obtain a refund in exchange for returning the product.
These statutory warranties apply independently of any commercial return policy offered by ACCOLADE.
